| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter H, Government Code, is amended by | ||
| adding Section 411.210 to read as follows: | ||
| Sec. 411.210. PURCHASES AND SALES OF AMMUNITION. (a) In | ||
| this section "ammunition" means any cartridge, shell, or projectile | ||
| intended for use in a firearm. | ||
| (b) A person commits an offense if the person intentionally | ||
| or knowingly sells ammunition and the person accepts anything other | ||
| than the following as payment for the ammunition: | ||
| (1) United States currency; | ||
| (2) a negotiable instrument in the form of a check that | ||
| meets the requirements of Section 3.104, Business & Commerce Code; | ||
| and | ||
| (3) a debit made through a financial institution debit | ||
| card. | ||
| (c) A person commits an offense if the person intentionally | ||
| or knowingly sells ammunition for a firearm to a person who is | ||
| younger than 18 years of age. | ||
| (d) A person commits an offense if the person intentionally | ||
| or knowingly sells ammunition for a firearm to a person without | ||
| verifying the age of the purchaser by examining a driver's license | ||
| or identification card issued by the state or by the United States | ||
| government, a passport, or other government-issued documentation | ||
| that provides the person's name, date of birth, and photograph. | ||
| (e) An offense under this section is a Class A misdemeanor. | ||
| SECTION 2. This Act takes effect September 1, 2023. | ||
