A BILL TO BE ENTITLED
1 AN ACT
2 relating to prohibiting discrimination by financial institutions
3 against lawful companies and businesses in the firearms and
4 ammunition industry.
5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
6 SECTION 1. Finance Code, Title 3, Subtitle Z, is amended by
7 adding Chapter 282 to read as follows:
8 Sec. 282.001. DISCRIMINATION AGAINST LAWFUL FIREARMS OR
9 AMMUNITION COMPANIES PROHIBITED. (a) A financial institution as
10 defined by Section 201.101 is prohibited from discriminating
11 against lawful firearms and ammunition industry companies or
12 businesses based solely upon such a company’s or a business’s
13 engagement in the constitutionally protected commerce subject
14 matter of firearms or ammunition.
15 (b) The banking commissioner shall administer and enforce
16 this law, and per Finance Code Section 31.101, bring to bear all
17 administrative remedies, including the de-charter of a financial
18 institution found to be in violation of this section.
19 SECTION 2. This Act takes effect September 1, 2023.
